Social mediaplatforms use algorithmic and AI tools to disseminateadvertisements online. These tools have been found,repeatedly, to perpetuate unlawful discrimination onthe basis of race, gender, age, and other legally protectedcharacteristics, irrespective of the advertisers’ intent orefforts to advertise fairly.

When a social media platform distributes an economicopportunity advertisement towards (or away from)a population based on a protected status (or a proxyfor that protected status), the result may violate antidiscrimination laws, including the prohibitions ondisparate impact and intentional discrimination.
